These terms govern the contracting of services provided by Generando Ideas Brillantes LLC («GIB») through this website. Requesting a quote or contracting a service implies acceptance of these terms.
1. Scope and services
GIB is a digital agency offering web design and development, AI automation, paid media, SEO, social media, ecommerce, email marketing, CRO, influencers, and events and experiences. The specific scope of each project is defined in the corresponding proposal or quote.
2. Quotes and contracting
Every project starts with a prior, detailed quote accepted by both parties. The quote specifies the scope, deliverables, timelines and investment. Unless stated otherwise, quotes are valid for 30 days.
3. Prices and payments
Unless otherwise agreed in writing, the usual payment model for development projects is 50 % upfront (which reserves dates and opens the project) and the remaining 50 % on delivery. Recurring services (maintenance, marketing, social media) are billed periodically as agreed. Amounts do not include any applicable taxes.
4. Timelines and client collaboration
Estimated timelines depend on the client providing, in good time, the necessary content, access and approvals. Delays in such collaboration may affect delivery dates.
5. Intellectual property of deliverables
Once the project is fully paid, the client acquires the rights to use the final deliverables. GIB reserves the right to showcase the work in its portfolio and promotional materials, unless a confidentiality agreement states otherwise. Licences for third-party software, fonts or resources are governed by their own terms.
6. Revisions and scope changes
Each project includes the number of revision rounds stated in the proposal. Changes that exceed the agreed scope may involve an adjustment to the quote and timelines, communicated and accepted in advance.
7. Warranties and liability
GIB applies its best professional effort to every project. However, it does not guarantee specific business results (such as sales volumes or exact search-engine rankings), as these depend on factors beyond its control. GIB's liability is in any case limited to the amount paid for the service giving rise to the claim.
8. Cancellation
If the client cancels once the project has started, amounts paid for work already carried out are non-refundable. Recurring services may be cancelled with the notice agreed in each case.
9. Governing law and jurisdiction
